Terms of Service

Article 1 — Purpose

These terms of service ("Terms") govern the provision by Janoubi — Creative Technology Studio ("Janoubi") of the WawCardsservice of creating, personalising and publishing digital invitation cards ("the Service") to any person placing an order ("the Client"). Any order implies full and unreserved acceptance of these Terms.

Article 2 — Definitions

"Design": a digital invitation card template from the Janoubi catalogue, comprising the design, the personalisation (photos, texts, colour adjustments carried out by Janoubi) and the features described in the catalogue. "Card": the Client's personalised digital card, accessible online. "Guest": a recipient of the invitation. "Event": the celebration to which the Card relates. "Proof approval": the Client's sign-off of the Card before it goes online.

Article 3 — Ordering

Orders are placed by WhatsApp or through the website form, indicating the chosen Design and confirmation mode (Online reply or Direct confirmation). Janoubi confirms availability and sends a summary (design, mode, price, elements to provide, schedule). The order becomes firm upon payment of the deposit provided for in Article 5.

Article 4 — Prices

Catalogue prices are expressed in CFA francs, all taxes included; VAT (TPS) at the rate of 9.5% is included in the prices displayed. The price shown on the catalogue cards corresponds to the Direct confirmation mode; the Online reply mode carries a supplement indicated before the order is sent. The price covers the design, the personalisation, the publication and the features described in the catalogue. Bespoke work is quoted separately.

Article 5 — Payment

Payment is made offline: mobile money, bank transfer or payment at the agency against receipt. Terms: fifty per cent (50%) of the total amount upon ordering; the balance before the Card goes online. No Card is published before full payment. If the balance remains unpaid fifteen (15) days after notification of the approved proof, Janoubi may cancel the order and retain the deposit.

Article 6 — Elements to provide and lead times

The Client provides the necessary elements: photographs of sufficient quality, texts, dates, venues and times, and music where applicable. The indicative delivery time for the draft Card is seventy-two (72) working hours from full receipt of the elements and the deposit. Any delay or incompleteness of the elements postpones delivery accordingly, without liability on Janoubi's part.

Article 7 — Approval — proof

Janoubi submits the Card to the Client for approval. The Client's written approval (including by WhatsApp message) constitutes the proof approval and authorises publication. After approval, the Client remains solely responsible for any residual errors or omissions they have approved (dates, venues, spelling of names, choice of photos). One (1) round of minor corrections is included after publication; additional requests or substantial changes are billed separately, with the cost communicated in advance. Each new change request adds twenty-four (24) working hours to the delivery time.

Article 8 — Publication and duration

The Card is accessible at a dedicated address until thirty (30) days after the date of the Event, then deactivated. An extension is available as a paid option. Janoubi may keep a technical archive copy for the period provided for in Article 11.

Article 9 — Client-provided content — warranties

The Client warrants that they hold all rights and authorisations over the content they provide (photographs, texts, music, information), including the image rights of the persons appearing in the photographs. The Client indemnifies Janoubi against any third-party claim relating to this content and will compensate Janoubi for any award, costs and fees resulting from it. Janoubi may refuse any content that is manifestly unlawful or contrary to public order or morality.

Article 10 — Music

When the Client wishes to add background music, they choose and provide it under their sole responsibility, warranting that they hold the rights required for its playback on the Card. Janoubi is not required to verify the rights status of the works provided and may refuse a manifestly problematic track.

Article 11 — Personal data

No guest phone number is required, whichever mode is chosen. In Online reply mode, the replies entered by Guests (name, number of people, optional message) are processed for the sole purpose of transmitting them to the organiser, on behalf of the Client; they are accessible from the Client's private dashboard, are neither sold nor used for prospecting, and are deleted no later than sixty (60) days after the Event, unless a legal obligation provides otherwise. In Direct confirmation mode, no Guest reply is stored by Janoubi. Details are set out in the privacy policy. Requests for access, rectification or deletion may be sent to invitations@janoubi.net.

Article 12 — Availability and liability

Janoubi is bound by an obligation of means. The Service relies on third-party hosting infrastructure; Janoubi does not guarantee uninterrupted availability and is not liable for interruptions attributable to these third parties, to communication networks, to the Guests' devices or to force majeure. The online reply feature is a reply-collection tool: Janoubi guarantees neither the replies nor the actual attendance of Guests. In any event, Janoubi's total liability under an order is capped at the amount actually paid by the Client for that order.

Article 13 — Intellectual property

Ownership of the System.The software engine, source code, theming system, section catalogue, templates, reusable graphic components, back office and technical architecture ("the System") are and remain the exclusive and inalienable property of Janoubi. This service does not in any way constitute a transfer, in whole or in part, of the System.

Client content. The content provided by the Client (photographs, texts, names, dates, logos) remains their property. The Client grants Janoubi the right to use it solely for the purpose of producing, hosting and displaying their Card.

Limited licence of use. Janoubi grants the Client, for the Card produced, a personal right of use that is non-exclusive, non-assignable, non-transferable and strictly limited to the event concerned: viewing the Card, sharing its link with their Guests and managing the authorised settings through the dedicated dashboard provided by Janoubi.

Prohibitions.The Client shall not: (a) copy, reproduce, download, decompile or attempt to extract all or part of the code or the System; (b) resell, rent, lend, sublicense, assign or redistribute the Card or the System to a third party, whether free of charge or for consideration; (c) reuse the design or the template for another event without a new order from Janoubi; (d) remove or alter the "création Janoubi" attribution.

Delivery as a hosted service. The Card is provided exclusively as a service hosted by Janoubi. No source file, static export or hostable copy is handed over. Janoubi may mention the work in its commercial references, unless the Client objects in writing. Any breach of this article entitles Janoubi to suspend the Service immediately, without refund, and to seek compensation for the damage suffered.

Article 14 — Cancellation — postponement

Cancellation by the Client before any work has begun: the deposit is refunded, less the costs incurred. Once personalisation work has begun, the deposit remains with Janoubi. If the Event is postponed, Janoubi endeavours, without any obligation of result, to adapt the Card to the new dates; a postponement does not give rise to a refund.

Article 15 — Complaints

Any complaint should be addressed to invitations@janoubi.net or to +241 077 75 86 56. The parties will endeavour to resolve any dispute amicably before any legal action.

Article 16 — Governing law and jurisdiction

These Terms are governed by Gabonese law and, where applicable, by the OHADA uniform acts. Failing an amicable settlement, exclusive jurisdiction is granted to the courts of Libreville.
